Shu"t HaRiva"sh HeChadashot - First Edition, Copy which Belonged to the Maharsha"m of Berzan, Signed by him, with a Gloss in his Hand
Shu"t HaRiva"sh HeChadashot. First edition. Munkacs, 1901 - one of the most important books of adjudication. Copy which belonged to the Maharsha"m of Berzan - leading adjudicator and responder of his generation, with the addition of a gloss in his hand.
His signature appears on the title page: "הק' שלום מרדכי הכהן אבדפ"ה" and on the back of the title page, there is a lengthy comment [19 words] about the content of the book, also in the Maharsha"m's handwriting.
Shu"t HaRiva"sh by Rabbi Yitzchak bar Sheshet [1326-1408], was one of the Earlier Authorities, a disciple of the Ra"n. Rabbi Yosef Karo, in Shu"t Avkat Rochel, attests that his rabbi, Rabbi Ya'akov Beirav, preferred the Riva"sh's responsa over those of other adjudicators.
The gaon Rabbi Shalom Mordechai HaKohen Schwadron [1835-1911], Av Beit Din of Berzan, was known by the nickname 'HaMaharsha"m MiBerzan.' He was a Chassid of the 'Sar Shalom' of Belz, and also of Rabbi Meir of Premishlan. The Maharsha"m was the leading adjudicator and responder of his generation. While he was yet young, the author of Sho'el U'Meishiv already saw him as his successor in his method of halachic rulings. He is accepted as one of the elder Chassidim, because his rabbi, the Sar Shalom of Belz, instructed him that due to his being considered the greatest expert of his generation, he was to be 'the power of permission,' that is, to rule according to the lenient opinion, in order to ease matters for the Jewish people. His ruling to rely on machine-made matzah on Passover, despite his being a member of the Chassidic community, stood out. He also wrote: (Shu"t Part II, 247) that because transferring electricity on Shabbat did not occur in the tabernacle, it is not prohibited from the Torah. In the foreword to his book Techelet Mordechai on the Torah, there are many tales of wonder brought about visions he saw with Divine inspiration, and about salvations he worked with his Torah prowess. He composed dozens of works, including: Shu"t Maharsha"m (six volumes with over 2300 responsa), Da'at Torah, Shu"t Darkei Shalom, Mishpat Shalom, Techelet Mordechai and others.
